A BILL

To amend the Prohibition Against Restrictive Confinement Bill to remove the exception for the farrowing period, and for other purposes.

SECTION 1. SHORT TITLE.

      This act may be cited as the “Amendment to Prohibition Against Restrictive Confinement Act of 2021” or the “Pregnant Pigs Act”. 

​

SEC. 2. PROHIBITION AGAINST CONFINING PREGNANT PIGS

      (a) In General. – The Prohibition Against Restrictive Confinement Act (ORS 600.150 et seq.) is amended by striking from the Act the following:

​

“SEC. 600.150. PROHIBITION AGAINST RESTRICTIVE CONFINEMENT.

      “(3) Subsection (2) of this section does not apply to a pregnant pig

      (f) In the seven-day period before the pig farrows.”

SEC. 3. PROHIBITION AGAINST CONFINING PREGNANT PIGS

      (a) In General. – The Prohibition Against Restrictive Confinement Act (ORS 600.150(3)(e) is amended by adding the following:

​

“SEC. 3.  SUBSECTION (2) OF THIS SECTION DOES NOT APPLY TO A PREGNANT PIG:

      (e) During an examination, operation or test by a veterinarian or during temporary treatment for veterinary purposes; or

            (ii) Any crate used for veterinary purposes must be large enough to allow the pig to turn around freely and fully extend their limbs while lying down.

SEC. 4. PROHIBITION ON CONFINING PREGNANT PIGS

      (a) In General. – The Prohibition Against Restrictive Confinement Act (ORS 600.150(1) is amended by adding the following:

“SEC. 1. AS USED IN THIS SECTION:

      (c) “Gestating sow” means a confirmed pregnant pig.

      (d) “Farrowing” means the process of a gestating sow giving birth to offspring.

      (e) “Farrowing crate” means a structure in which a single sow is kept prior to and during farrowing that either prevents her from turning around and fully extending her limbs within the structure, or confines her to lie on her side, and separates her from her offspring.

      (f) “Gestation crate” means a structure in which a single pig is kept, commonly used for gestating sows.

 

APPLICABILITY – The amendment made by this section shall apply beginning on the date that is one year after the date of the enactment of this Act.
